Changes to these terms

These terms were created on 4/19/2010.

Use of the site constitutes your acceptance of these terms and conditions which take effect on the date which you first use the site. Rainbow Drive In, LLC reserves the right to change these terms and conditions at any time by posting changes on-line. Your continued use of this site after changes are posted constitutes your acceptance of these terms and conditions as modified by the posted changes.

If these terms and conditions are not accepted in full, you do not have permission to access the contents of this website and therefore should cease using this website immediately.

Retail Contract

When you place an order with us and complete payment, you are accepting a contract between you as the buyer and us as the vendor.  A contract is not assumed if checkout and payment is not complete.

In the unlikely event that the goods are no longer available, or a pricing mistake, we will advise you of this and there will be no contract between us and reimbursement of funds will be made back to you.

If the goods ordered are not available, we may contact you to substitute goods equal in value.  If decided not to accept the substitute goods, we will reimburse funds back to you.

Placing an Order

To place an order, navigate to products page and choose product category.  Select products that you are interested in and click add to cart.  When ready, click the checkout button and proceed with payment steps.  Once payment steps are complete and order is submitted, you will receive an email confirming acceptance of order.

Delivery

After order confirmation is received by the customer, order will take up to 2 business days to ship (holidays and weekends do not count as business days).  Once order is shipped, the shipping type and location will determine the number of days it will take to reach the customer.  Delivery charges are based on the shipping type and the total weight of the product.  This is automatically calculated by our shipping interface to provide the most accurate costs.

If goods are lost or damaged in transit, please let us know promptly, so that we can make a claim against the carriers.  We will offer you the choice of a replacement or a full refund.

Cancellation and returns

This cancellation policy does not affect your rights when we are at fault – for example, if goods are faulty or not described accurately.

You may cancel your order before delivery, and up to 7 working days after delivery.  To do this, please e-mail us or write to us.  We will refund your money, including original postage charges, within 30 days.

You do not have to give any reason for cancellation.  However a brief explanation will help us to improve the service we offer to customers in the future.

If you cancel, you must return the goods to us at your own expense.  You are responsible for the risk of loss or damage when you return goods, so you should take out enough postal insurance to cover their value.

If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection.  If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

Defective goods

If there is a problem with the goods, please contact us to discuss the matter further.

If the goods are found to be faulty within a reasonable time after delivery, you may reject them and claim a full refund.

If a fault is found later on, or if you delay in making a complaint, you will still be entitled to a replacement.  If a replacement is not available, you may be able to claim a part or full refund of your money.
